A common concern in the architectural community is whether third-party software providers harvest project information to compete, pass leads, or capitalize on prospective developments.

We state our position plainly and unequivocally:

Binding IP Non-Exploitation Pledge

Plan Comply, its operating entity CodeWays (Pty) Ltd, and its personnel will NEVER under any circumstances:

  • Use your uploaded plans, project locations, or client identities to source property deals, broker land sales, or pitch development contracts.
  • Compete against your architectural studio, draughting practice, or engineering consultancy.
  • Share, sell, license, or leak your drawings to competing architects, construction contractors, property developers, or real estate brokers.
  • Underbid or undercut public, private, or municipal tenders based on insights gained from your submitted drawings.
02. Permitted Use & Betterment

Analytical & Bettering Purpose Only

When you upload architectural drawings (PDFs, BIM/CAD exports, or scan images) to Plan Comply, the data is processed solely for two legitimate technical purposes:

1. Direct Compliance Audit Generation

Evaluating your specific drawing set against SANS 10400 clauses, Act 103 of 1977, and local municipal bylaws to produce your actionable pre-submission audit report and CAD checklist.

2. Algorithmic Accuracy Betterment

Aggregated, anonymized drawing geometry is analyzed internally to refine computer-vision precision, reduce false positives, calibrate hatching recognition, and keep rules synchronized with municipal standards.

This algorithmic refinement is strictly mathematical and internal. It is never associated with client identities, financial valuations, or project locations.

03. Intellectual Property Ownership

Your Intellectual Property Remains 100% Yours

Uploading a drawing to Plan Comply does not transfer, assign, or license any intellectual property, copyright, moral right, or trademark to Plan Comply or CodeWays (Pty) Ltd.

You retain full, exclusive ownership of all architectural drawings, detail schedules, 3D renderings, site layouts, title blocks, and specifications. You grant Plan Comply solely a temporary, non-exclusive, revocable technical license to process the document for the duration necessary to deliver the audit report and maintain your dashboard history.

04. Edge Security & Storage Architecture

Isolated Cloudflare Infrastructure & Encryption

Plan Comply is built on modern, Zero-Trust Cloudflare edge infrastructure to ensure enterprise-grade security:

  • Encrypted in Transit & at Rest: All drawing uploads and API communications utilize TLS 1.3 encryption. Stored drawing files are encrypted at rest using AES-256 in private Cloudflare R2 object buckets.
  • Isolated Tenant Access: Only you (authenticated via your Google or verified email magic-link session) can view, download, or inspect your drawing sets and historical audit reports.
  • User Deletion Rights: You can delete any audit report and its underlying drawing set directly from your dashboard at any time. When deleted, associated storage references are purged.
05. POPIA Compliance

Protection of Personal Information Act (POPIA)

In accordance with the Protection of Personal Information Act (Act 4 of 2013) of the Republic of South Africa:

  • Lawful Processing: We collect and process user email addresses, names, SACAP registration numbers, and drawing metadata solely to maintain your account, authenticate sessions, and fulfill plan audits.
  • No Third-Party Marketing: We never sell, rent, or trade your contact details or client names to marketing aggregators or unsolicited advertisers.
  • Data Subject Rights: You have the right to request access to your personal information, request correction of inaccurate data, or request complete deletion of your account and audit history.
