Terms of Service & User Agreement

Please read these terms carefully before utilizing the Plan Comply pre-submission architectural compliance audit console and credit services.

1. Acceptance of Terms

By creating an account, purchasing audit credits, or uploading architectural drawings to Plan Comply (operated by CodeWays (Pty) Ltd, registration number 2024/237248/07), you agree to be bound by these Terms of Service, our Pre-Submission Regulatory Disclaimer, and our Privacy & IP Non-Exploitation Charter.

2. Nature of the Service & Pre-Submission Scope

Plan Comply provides an automated diagnostic pre-check tool designed to assist architectural professionals, draughtspersons, and property developers in reviewing architectural drawing sets against SANS 10400 standards and municipal bylaws.

Plan Comply is an independent screening tool and does not constitute statutory municipal approval. Final statutory approval remains the exclusive jurisdiction of the appointed municipal Building Control Officer (BCO) under the National Building Regulations and Building Standards Act (Act 103 of 1977).

3. Intellectual Property & Non-Exploitation

You retain 100% ownership and copyright of all drawings, designs, and CAD/PDF files uploaded. We process uploaded files solely for automated compliance audit execution and internal model betterment. As detailed in our Charter, Plan Comply will never use your drawings, client details, or project information to solicit commercial deals, broker land, pitch construction contracts, or undercut tender bids.

4. Audit Credits & Payments

Audit credits purchased via Stripe (Visa, Mastercard, Apple Pay, Google Pay) or supported settlement providers are applied instantly to your account. Credits never expire and remain valid for future plan audits. Unused credits may be refunded upon request within 14 days of purchase, provided no audit has been initiated using those credits.

5. Limitation of Statutory Liability

While we continually work alongside government standards and practicing architects to maintain maximum audit accuracy, Plan Comply and CodeWays (Pty) Ltd shall not be liable for any direct, indirect, consequential, or statutory delays, municipal plan rejections, redesign fees, or financial losses arising from municipal decisions, examiner discretion, or site-specific zoning disputes. The registered architectural professional of record retains ultimate responsibility for all statutory submissions.

6. Governing Law & Inquiries

These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any dispute shall be submitted to the competent jurisdiction of South African courts. For legal notices or inquiries, contact [email protected].
